Part I — Definitions

The following terms used in these Terms and Conditions shall have the meanings set out below:

Seller — Paulina Blachura, trading as Paulina Blachura STUDIO B3, ul. Jana Zamoyskiego 33/21, 30-519 Kraków, Poland; registered in the Central Register and Information on Economic Activity (CEIDG); NIP: 6772287453; REGON: 120754453; e-mail: onlineshop@studiob3.pl; phone: +48 606 987 555 (Mon–Fri 9:00–17:00 CET).

Online Store — the e-commerce platform operated by the Seller at www.studiob3.pl, through which Customers may browse Products and place Orders.

Customer — any adult natural person with legal capacity, sole proprietor, legal person, or unincorporated entity placing an Order via the Online Store.

Consumer — a natural person concluding a Sale Contract not directly related to their commercial or professional activity (as defined in Art. 22(1) of the Polish Civil Code).

Consumer-Entrepreneur — a sole proprietor concluding a Sale Contract directly related to their business, but not of a professional nature for that person (Art. 385(5) of the Polish Civil Code). Consumer-Entrepreneurs enjoy consumer protection rights unless otherwise stated.

Product — original, hand-crafted women's clothing and accessories (bags, hats) designed by studio b3 and manufactured in Poland in limited quantities.

Made-to-Order Product — a Product not held in stock at the time of Order, which the Seller manufactures specifically following receipt of the Order.

Product Page — the individual page on the Online Store describing a specific Product, including price, available sizes/colours, and estimated delivery.

Price — the gross price of the Product shown on the Product Page, in EUR or USD, inclusive of any applicable VAT. Delivery costs are shown separately.

Order — the Customer's declaration of intent to purchase one or more Products, submitted via the Online Store.

Sale Contract — the contract for the sale of Products concluded between the Seller and the Customer upon Order Confirmation.

Order Confirmation — the e-mail sent by the Seller confirming acceptance of the Customer's Order and marking the conclusion of the Sale Contract.

Account — an optional registered profile on the Online Store allowing the Customer to track Orders, view Order history, and manage their details.

Business Days — Monday to Friday, excluding Polish public holidays.

Civil Code — the Polish Act of 24 April 1964 (consolidated text, Journal of Laws 2023, item 1610, as amended).

Consumer Rights Act — the Polish Act of 30 May 2014 on consumer rights (consolidated text, Journal of Laws 2023, item 2759, as amended), implementing Directive 2011/83/EU.

GDPR — Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016.

Terms and Conditions — this document, available at www.studiob3.pl/terms.

Part II — General Provisions

Orders placed via the Online Store are governed by these Terms and Conditions and applicable Polish and EU law.

Product information on the Online Store does not constitute a binding offer within the meaning of Art. 66 of the Civil Code; it is an invitation to place an offer (Art. 71 Civil Code). The Sale Contract is concluded upon Order Confirmation.

All Prices are displayed in EUR or USD and are gross prices (inclusive of applicable VAT). The currency can be selected by the Customer. VAT is charged in accordance with applicable rules for the Customer's country of residence.

Products are available in limited quantities. Orders are processed in the order received.

Due to the nature of the Products — hand-crafted and garment-dyed — minor variations in colour, texture, or dimensions between individual items are inherent to the production process and do not constitute defects.

To use the Online Store, the Customer needs: a device with internet access, a current web browser (Chrome, Firefox, Safari, or equivalent), and an active e-mail address.

Part III — Pricing and Promotions

All Prices displayed on the Online Store are gross prices in EUR or USD, inclusive of any applicable VAT.

Whenever the Seller announces a price reduction (sale, discount, promotional price), the Online Store will display the lowest price at which the Product was offered in the 30 days immediately preceding the promotion. This applies to all price reductions directed at EU consumers, regardless of their country of residence within the EU.

Where a Product is newly listed and has been available for fewer than 30 days before a price reduction is applied, the reference price shown will be the lowest price since the Product was first listed.

The Seller does not artificially inflate prices prior to announcing a promotion. All discounts are calculated against genuine prior pricing.

If the Online Store displays customer reviews, only reviews from verified purchasers will be published. The Seller does not commission, manipulate, or selectively suppress customer reviews.

The Seller does not use personalised pricing based on automated profiling without the Customer's knowledge.

Part IV — Customer Account

Account registration is optional. Customers may place Orders without creating an Account.

To create an Account, the Customer provides their e-mail address and sets a password. Upon confirmation of registration, a service agreement for Account operation is concluded between the Seller and the Customer for an indefinite period.

The Customer is responsible for maintaining the confidentiality of their login credentials. The Seller does not have access to the Customer's password.

The Customer may delete their Account at any time by sending a request to onlineshop@studiob3.pl. Deletion of the Account does not affect any Sale Contracts already concluded.

The newsletter service is available to Customers who consent at registration or at checkout. The Customer may unsubscribe at any time by clicking the unsubscribe link in any newsletter e-mail.

Complaints regarding electronic services (Account, newsletter) should be sent to onlineshop@studiob3.pl. The Seller will respond within 30 days.

Part V — How to Place an Order

Orders may be placed 24 hours a day, 7 days a week. Orders are processed by the Seller on Business Days.

To place an Order, the Customer: (1) selects the Product and any available parameters (size, colour); (2) adds the Product to the cart; (3) proceeds to checkout; (4) provides delivery and billing details; (5) selects a payment method; (6) confirms they have read these Terms and Conditions; (7) clicks 'Order & Pay'.

By clicking 'Order & Pay', the Customer submits a binding offer to purchase the selected Products at the stated Price.

The Seller sends an automatic order acknowledgement by e-mail immediately after the Order is submitted. This acknowledgement does not yet constitute acceptance of the Order.

The Sale Contract is concluded when the Seller sends the Order Confirmation e-mail, typically within 1–2 Business Days of the Order being placed.

The Customer may amend or cancel the Order at any time before receiving the Order Confirmation. After Order Confirmation, the Customer's right of withdrawal applies as set out in Part VIII.

Part VI — Payment

The following payment methods are available:

  • Stripe — credit or debit card (Visa, Mastercard, American Express) or other Stripe-supported methods. Payments processed by Stripe Payments Europe, Ltd., Dublin, Ireland.
  • PayPal — via PayPal account or as a guest using a card. Payments processed by PayPal (Europe) S.à r.l. & Cie, S.C.A., Luxembourg.

Payment is due at the time of placing the Order. The Order will not be confirmed until payment is successfully processed.

All transactions are processed securely via encrypted connections (TLS/SSL). The Seller does not store card details.

A VAT invoice is issued for every Order and sent to the Customer by e-mail. EU Customers outside Poland are charged VAT in accordance with EU VAT rules (OSS scheme). Non-EU Customers are charged 0% VAT; import duties and local taxes may apply.

Part VII — Delivery

7.1 Dispatch Times

Orders are usually dispatched within 1–2 Business Days of Order Confirmation. Made-to-order Products are dispatched within a maximum of 7 Business Days.

If the Seller is unable to fulfil the Order within the above timeframe, the Seller will notify the Customer promptly and offer: (a) a revised dispatch date; (b) an exchange for an equivalent Product; or (c) a full refund.

7.2 Shipping

The Seller ships worldwide via DHL Express, DHL Parcel, or an equivalent courier. Available shipping options and costs are presented at checkout.

Risk of loss passes to the Customer (if not a Consumer) upon handover to the carrier. For Consumers, risk passes upon physical receipt of the Product.

Import duties, customs fees, and local taxes for deliveries outside the EU are the sole responsibility of the Customer. The Seller declares the true value of goods on customs documentation.

7.3 Inspection on Receipt

Upon receipt, the Customer is encouraged to inspect the package for transport damage. If damage is visible, the Customer should note this with the carrier and contact onlineshop@studiob3.pl within 48 hours.

Part VIII — Right of Withdrawal

This Part applies to Consumers and Consumer-Entrepreneurs only.

The Consumer and Consumer-Entrepreneur have the right to withdraw from the Sale Contract without giving any reason within 30 days of taking physical possession of the Product.

To exercise the right of withdrawal, the Customer must notify the Seller by an unambiguous statement (e-mail to onlineshop@studiob3.pl or letter to: studio b3, ul. Jana Zamoyskiego 33/21, 30-519 Kraków, Poland) before the 30-day period expires.

The Customer must return the Product within 14 days of sending the withdrawal notice, to: studio b3 Paulina Blachura, ul. Beskidzka 30b, 30-611 Kraków, Poland.

The direct cost of returning the Product is borne by the Customer.

The Seller will refund the full Price of the Product, including the original standard delivery cost, within 14 days of receiving the returned Product or proof of return (whichever is earlier). Refunds are made using the same payment method as the original transaction.

The right of withdrawal does not apply to: (a) Products made to the Customer's specifications or clearly personalised; (b) Products that by nature cannot be returned.

Part IX — Complaints and Warranty

The Seller is liable for conformity of Products with the Sale Contract in accordance with the Consumer Rights Act and the Civil Code. The Seller's liability period is 2 years from delivery for Consumers and Consumer-Entrepreneurs.

If a Product does not conform to the contract, the Consumer or Consumer-Entrepreneur may request: (a) repair; (b) replacement; (c) a proportionate price reduction; or (d) withdrawal from the contract if the non-conformity is material and cannot be remedied.

Complaints should be submitted to onlineshop@studiob3.pl or by letter to: studio b3, ul. Beskidzka 30b, 30-611 Kraków, Poland. Please include: name, order number, description of the issue, and photographic evidence where applicable.

The Seller will respond to complaints within 14 days of receipt. Failure to respond within this period is deemed acceptance of the complaint.

Minor colour, texture, or dimensional variations inherent to garment-dyeing and hand-craft production do not constitute non-conformity.

Part X — Out-of-Court Dispute Resolution

The Seller accepts the possibility of resolving consumer disputes through out-of-court procedures under applicable Polish law.

Consumers may seek assistance from the Provincial Trade Inspectorate in Kraków, ul. Ujastek 1, 31-752 Kraków (www.krakow.wiih.gov.pl), and may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Use of out-of-court procedures is voluntary and does not affect the Customer's right to bring a claim before a competent court.

Part XI — Personal Data

The Seller is the controller of personal data provided by Customers in connection with the use of the Online Store.

Personal data are processed for the following purposes: (a) performance of the Sale Contract — Art. 6(1)(b) GDPR; (b) fulfilment of legal obligations — Art. 6(1)(c) GDPR; (c) newsletter and marketing — Art. 6(1)(a) GDPR (consent, withdrawable at any time); (d) legitimate interests of the Seller — Art. 6(1)(f) GDPR.

Personal data may be shared with: courier companies, payment processors (Stripe, PayPal), and IT service providers. Data are not sold to third parties.

Customers have the right to access, rectify, erase, restrict, object to processing, and portability of their data. Requests should be sent to onlineshop@studiob3.pl.

Customers have the right to lodge a complaint with the President of the Personal Data Protection Office (UODO), ul. Stawki 2, 00-193 Warsaw, Poland.

Part XII — Other Provisions

Matters not regulated in these Terms and Conditions are governed by Polish law, in particular the Civil Code, the Consumer Rights Act, and the GDPR.

Nothing in these Terms and Conditions excludes or restricts any rights granted to Consumers by the mandatory law of their country of residence.

The Seller may amend these Terms and Conditions for important reasons. Customers with Accounts will be notified at least 14 days before the effective date.

Should any individual provision be found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
